After completion of trademark restoration process, the trademark is again added to the trademark register for next 10 years. Trademark restoration provides the same legal protection as trademark registration and renewal.
The process of trademark restoration starts after the expiry of the trademark renewal date. An individual or entity can apply for trademark restoration anytime within 6 months to 1 year after the expiry date of trademark renewal. After the restoration process, trademark becomes valid for the next 10 years.
Form TM-R is used to file trademark restoration application. Both renewal (with surcharge) and restoration fees are applicable in this case.
