Trademark Renewal

Trademark renewal means extending the period of trademark registration by filing renewal application along with the prescribed fee. Registered trademark can be renewed for the period of 10 years. In case a person or entity fails to renew the registered trademark on time, then the mark will be removed as per the legal laws of trademark. Time to time renewal of registered trademark is very important in case you are having the responsibility of managing the portfolio of trademarks. There are serious repercussions to it, if the same has not been renewed before the deadline.

Trademark renewal is the most important step which gives protection to your business from infringement or copyright violation. The request of trademark renewal should be filed by the applicant much before the expiration or renewal date. It should be filed within 6 months before the expiry date.

The registrar always send the notice to the registered trademark owner in order to remind him that his or her trademark expiration date is approaching and he or she should file the application for their trademark renewal as early as possible with the prescribed fees. Once the expiry date of the trademark renewal is gone, the registrar removes the trademark from the trademark register.

The owner of the registered trademark can also file the renewal application within 6 months after the expiry date along with the late fees. There are two ways to renew your trademark –

  1. Renewal in case of change in any sign or words of the existing trademark.
  2. Renewal without any change

Form TM-R is used to file renewal application. The application can be made either by the owner of the registered trademark or by his or her authorized agent.
