Trademark opposition is the process which starts and takes place when trademark registrar approves the trademark application and gives approval to advertise the same in the trademark journal before the completion of registration process.
When the application has been filed by the applicant to the registrar for trademark registration, registrar processes the received application and issues an examination report. If the examination report allows and registrar approves the trademark application to be advertised in the trademark journal, any person from the public is allowed to oppose the trademark registration. If any individual or entity feels that the registration of the trademark is unfair, he or she has the full right to oppose that trademark registration application by filing a trademark opposition with the trademark registrar within 4 months from the date of publishing of trademark in the trademark journal. In response to the opposed application, counter statement should be filed by the applicant to the registrar within 2 months.
