IP-1 License Overview

IP means infrastructure provider. There is a need to ensure that the right infrastructure is provided in department of telecommunication (DOT). This in turn ensures that technologies used to support the other service providers are up to the mark.

With the help of IP-1 license, a company can provide –

  1. Technical aid such as dark fiber, right of way, tower and duct space.
  2. Other service providers with technological infrastructure.

Documents Required For DOT IP-1 License Registration

  1. PAN card of the company
  2. Certificate of incorporation of the company
  3. Copy of memorandum of association and articles of association of the company duly certified by the company secretary/director of the company.
  4. KYC of all the directors
  5. List of all the directors of the company
  6. List of all the shareholders of the company
  7. Payment of processing fee of Rs.5000 through pay order or demand draft.
  8. Equity details of the company showing clearly the Indian equity & foreign equity (direct + indirect both)
  9. The nationality of each partner/promoter/equity holder should be clearly stated. For ex – Resident Indian citizens/ NRI/ Foreign national.
  10. In case, FDI (foreign equity: direct + indirect) exceeds 49% in an Indian company, a copy of FIPB approval is also to be submitted.
  11. In case, a foreign partner/promoter/equity holder is involved, copy of agreement b/w Indian company and foreign partner is needed.

Eligibility Criteria for IP-1 License Registration

The eligibility criteria to apply for an IP-1 license in India are as follows –
  • You must have registered private or public limited company.
  • You must have term “interest infrastructure provider” mentioned in your company’s "memorandum of association".

Guidelines for IP-1 License Registration

The guidelines for infrastructure providers applying for IP-1 license registration are given below –

  • An applicant applying for the IP registration must have a company registered under companies act, 1956.
  • There is no limit imposed on the level of foreign equity in the applicant company.
  • The company should submit the registration application in the prescribed format.
  • In case you need to change the name of the company or the licensed IP-1, it should be done as per the provisions mentioned under the company’s act, 1956.
  • The company will be informed within 15 days’ time that whether your application is accepted or rejected.
  • The IP-1 registration should be done on non-exclusive basis without any restriction on number of entrants.
  • The IP-1 registered company should provide dark fibers, duct space, right of way, towers on lease or rent or on sale basis to the licenses of telecom services as per mutually agreed terms and conditions.
  • The applicant company should pay a processing fee of Rs.5000 along with the application form by pay order or demand draft.
  • The applicant shall make its own arrangement for right of way.
  • In case, IP-1 registered company entered into an agreement with other service providers or IP-II, IP-1 registered company has to submit a copy of agreement to the department of telecommunication within 15 days from the date of signing the agreement.
  • In case of IP-1 registered company, there should not be any discrimination in relation to providing infrastructure to other service providers.
  • The application for IP-1 registration should be submitted to the section officer on the following address – Section officer, CS-III Department of telecommunications, Room no. 713, Sanchar bhavan, 20-ashok road, New Delhi - 110001

IP-1 License Registration FAQ’S

Infrastructure companies need IP-1 license to provide assets like dark fiber, right of way, duct space and towers to internet service providers.
IP-1 license is valid for lifetime. You need to surrender your license in case you stop doing business.
This application takes around 2 months to complete the registration process.
In case you are having an ISP license, you can legally law down infrastructure to provide connectivity to your customers but in case you are renting your fiber to other internet service providers, you must need an IP-1 license.
