FCRA Registration in India

As per section 6(1) of foreign contribution regulation act (FCRA) 2010, every society, charitable trust and section 8 company that receive donations or contributions from foreign sources are required to obtain registration under this act. Registration under the foreign contribution regulation act, 2010 is known as FCRA registration. This law is implemented by the ministry of home affairs, government of India. The government has laid down certain rules & regulations for such transactions to discourage the illegal activities which can be harmful for the national security of our country.

Types Of FCRA Registration

FCRA registration is of two types –

  1. Proper FCRA registration
  2. Prior permission FCRA Registration
  • Proper FCRA registration-

    In order to be eligible to apply for FCRA registration, applicant needs to meet the following minimum requirements –
    • The applicant must be registered and its operations are for minimum period of 5 years.
    • The applicant must have spent minimum of 10 lakh rupees in the past 3 years for the advancement of its main objects. Make sure it does not include any type of administrative expenditure.
    • The applicant also needs to submit last 3 years financial statements audited by qualified chartered accountants.
  • Prior permission FCRA Registration –

    In case your organization is newly registered and you are willing to receive any type of foreign contribution, you need to apply for prior permission to do the same. In order to apply for prior permission, you need to meet the following minimum requirements mentioned below –
    • The funding is to be used for specific purpose
    • The detail of the foreign owner described at the time of making application.

Points To Be Considered Before Applying For FCRA Registration

Before applying for FCRA registration, the applicant must be cautious and take these following points into consideration –

  1. 1

    The applicant applying for FCRA registration or grant of prior permission –

    • Should not be fictitious
    • Should not be prosecuted or convicted in any case for making communal tension in any specific area or district or any other part of the country.
    • Should not be found guilty in diverting the funds.
    • Should not be prosecuted or convicted for involvement in activities aimed at conversion through force, either directly or indirectly or from one religious faith to another.
    • Should not prohibit any of the provisions of this act.
    • Should not be engaged in propagation of sedition or advocate violent methods to achieve its ends.
    • Should not use the foreign contribution for any personal gain or for undesirable purposes.
    • Should not be blocked from accepting foreign contribution.
    • Should not be convicted under any law or never prosecuted for any pending offense.
    • Any of the directors or office bearers should not be convicted under any law or no prosecution is pending against them.

    The foreign contribution acceptance should not affect unlawfully –

    • The public interest
    • The sovereignty & integrity of India
    • Friendly relations with any foreign state
    • Harmony between racial, social, religious, linguistic, regional groups, castes or communities.
    • The strategic, scientific, security or economic interest of the state.
    • Freedom or fairness of election to any legislature

    Foreign contribution acceptance

    • Should not risk the life or physical safety of any person
    • Should not lead to provocation of an offense.

Eligibility Criteria For FCRA Registration

As you know, FCRA registration is a mandatory requirement for receiving any kind of foreign contribution. Now, we have to discuss who is eligible to apply for FCRA registration. The applicant applying for FCRA registration must be a non-profit organization registered & operating under any of the following –

  • Registered society under societies registration act, 1860
  • Registered trust under Indian trust act, 1882
  • Section 8 company under companies act, 2013

In addition to organizational registration, following pre-conditions are also required to be satisfied by the applicant to receive foreign contributions –

  • The applicant organization must set up with the objective of charity to serve the society in the following areas –
    • Promotion of education
    • Promotion of health
    • Promotion of art
    • Promotion of culture
    • Promotion of region
    • Promotion of sports etc.
  • The applicant organization must not be prohibited under section 3 of the foreign contributions (regulation) act, 2010
  • After proper assessment of applications by the authorities, FCRA registration is granted to the applicant.

Documents required for FCRA Registration

The documents needed to be submitted for FCRA registration are as follows –

  • Registration Certificate of Association.
  • Memorandum of Association/Trust Deed.
  • Activity Report for the Last 3 Years.
  • Audited Statement of accounts for the last three years.

Documents required for Prior Permission FCRA Registration

The documents needed to be submitted for Prior Permission FCRA registration are as follows –

  • Registration Certificate of Association.
  • Memorandum of Association/Trust Deed.
  • Commitment Letter from the donor organization and agreement.
  • Project Report for which FC will be received.

Documents required for FCRA Renewal Registration

The documents needed to be submitted for FCRA Renewal registration are as follows –

  • Registration Certificate of Association.
  • Memorandum of Association/Trust Deed.
  • FCRA Registration Certificate of association issued by MHA.

Online FCRA Registration Procedure

The procedure of online FCRA registration is given below –

Step 1-

Go to FCRA online portal (https://fcraonline.nic.in/home/index.aspx)

Step 2-

Click on “FCRA online forms”

Step 3-

On the next screen, click on “application for FCRA registration” which will redirect you to the next page.

Step 4-

In the fourth step, you have to select “Click to apply online” button to apply for FC3 (form) registration.

Step 5-

In the fifth step, click on sign up to make your new username and password.

Step 6-

In the sixth step, enter data into all the mandatory fields and click on save.

Step 7-

After clicking save, you will get the message “User-id is created and your User-id is ………….”

Step 8-

In the eighth step, enter your newly made user ID & password and login to your account.

Step 9-

Select option “I am applying for” and choose FCRA registration from drop down menu. Click on apply online.

Step 10-

Click on “Proceed registration”

Step 11-

In the eleventh step, click on FC3 menu in the title bar to start the procedure of new registration.

Step 12-

In the twelfth step, the association form will be displayed and applicant needs to fill the mandatory details of the form along with the required documents –

  • Darpan ID
  • Association address
  • Registration number
  • Registration date
  • Nature of association
  • Main aim of the association

Step 13-

Click on submit button

Step 14-

In the step 14, click on executive committee option from the menu bar and go to executive committee form.

Step 15-

In step 15, you have to enter all the details of executive committee

Step 16-

Select “add details of key functionary”, you can now add/delete/edit the details you entered in executive committee.

Step 17-

To add further foreigner details, select the record checkbox and click on add/view button.

Step 18-

In the step -18, new screen will be displayed. You can also edit or delete the record by clicking on the appropriate option.

Step 19-

In step-19, you need to enter the EC details by selecting the option from the menu list.

Step 20-

After entering all EC details, click on save button

Step 21-

In step 21, you need to provide the bank details such as bank name, account number, IFSC code, bank address.

Step 22-

To provide all the other information, click on other details option.

Step 23-

You need to upload all the required documents in the pdf format in step 23.

Step 24-

In the step 24, you need to click on the final submission button on the menu bar after entering the place & date.

Step 25-

After submission, a pop up window will appear. Click on ok.

Step 26-

In step 26, click on “make online payment” button on the menu bar, the payment screen will be displayed.

Step 27-

Click on the continue button to do the payment. A pop up window will appear on the screen. Choose the payment gateway and click on payment.

NOTE – After making submission, you cannot modify any of the application details.

Validity Of FCRA Registration

FCRA registration is valid for a period of 5 years and not for lifetime. There are two cases for which the validity period is given below –

FCRA registration

The validity of FCRA registration is 5 years from the approval date. After the expiry period, it will be renewed to receive any further foreign contribution.

Prior permission

Validity period is 5 years from the approval date. Validity will not expire until the foreign contribution is fully utilized for which the prior permission is granted.

Renewal Of FCRA Registration

After the expiry of FCRA registration, organization needs to file a renewal application for which the timelines are given below –

  • Usually, the registered organization needs to submit the renewal application at least 6 months before the registration lapses.
  • In case the registered organization is working on ongoing multi-year projects, then the organization needs to submit the renewal application at least 12 months before the registration lapses.

Cancellation Of FCRA Registration

FCRA registration may get cancelled by the authorities in case the operations of the organization are not as per the provisions of the law. In the last 4 years, more than 4000 FCRA registrations have been cancelled due to non-compliance of provision. There are many reasons by which FCRA registration can become cancelled. The few of the reasons are mentioned below –

  • The organization fails to submit required compliances under foreign contribution (regulation) act, 2010 or any other regulatory laws.
  • In case the allegation or complaint is made against the organization in relation to any illegal activity in the operations of the organization.
  • The foreign contribution received by the organization is utilized for any other purpose different from what is stated in the FCRA registration application.

Return Requirement After FCRA Registration

After successfully registering your organization with FCRA, the organization use form FC-4 to submit their returns annually.

After registration, organization records all the foreign contributions received and submit form FC-4 online to file a return annually. In addition to the online application form, organization needs to submit the scanned copies of the following documents certified by CA –

  • Income & expenditure statement
  • Balance sheet
  • Statement of receipt of foreign contribution
  • Payment made by the entity

Application form FC-4 is needed to be filed along with the required documents within 9 months of the closing of every financial year i.e. 31st December of every year.
